About These Privacy Policy

This page sets out our privacy policy in full. Please read it before using the site. Alternatively, call us if anything here needs clarifying.

This Privacy Policy explains how Apex Asphalt (“Apex Asphalt”, “we”, “us”, or “our”) collects, uses, and shares information when you visit apexasphalt.org (the “Site”) or contact us about our services. We serve customers in Salt Lake, Utah, Davis, Tooele, and Wasatch Counties, Utah.

1. Information You Give Us

When you submit our quote or contact form, or call or email us, we collect the information you choose to provide. That typically includes your name, phone number, email address, project type, and a description of your project. It may also include your property address, since we need it to evaluate and schedule work.

Please do not send us sensitive personal information — such as government identification numbers, financial account numbers, or health information — through the Site.

2. Information Collected Automatically

Like most websites, we and our service providers automatically collect certain technical information when you visit, including your IP address, browser type and version, device type, operating system, referring page, the pages you view, and the dates and times of your visits. This is collected through cookies and similar technologies.

3. Cookies and Analytics

We use cookies and similar technologies to operate the Site, remember preferences, and understand how the Site is used. We use Google Analytics and Google Search Console, provided by Google, to measure traffic and understand how visitors find and use the Site. These tools may set cookies and collect information about your visit.

You can learn about Google’s practices at policies.google.com/privacy, and you can opt out of Google Analytics using Google’s browser add-on at tools.google.com/dlpage/gaoptout.

Most browsers let you refuse or delete cookies through their settings. Blocking cookies may affect how parts of the Site function. Some browsers offer a “Do Not Track” signal; because there is no common industry standard for responding to it, the Site does not currently respond to those signals.

4. Advertising

We advertise our services online, including through Google. Advertising platforms may use cookies or similar technologies to measure ad performance and to show our ads to people who have visited the Site. We do not sell your personal information.

5. Embedded Video

Pages on the Site embed video hosted by YouTube. Our video embeds are configured to load only after you choose to play them, which limits the data YouTube receives from visitors who do not interact with the video. Once you play an embedded video, YouTube may set cookies and collect information under Google’s privacy policy.

6. How We Use Information

We use the information we collect to respond to your inquiries and provide estimates; to schedule, perform, and follow up on services; to send invoices and process payment; to communicate with you about your project; to operate, secure, and improve the Site; to measure the effectiveness of our advertising; and to comply with legal obligations and enforce our agreements.

We will only send you marketing messages if you have asked for them or have an existing relationship with us, and every such message will include a way to opt out.

7. How We Share Information

We do not sell your personal information, and we do not rent or trade it.

We share information only as follows: with service providers who perform functions on our behalf — website hosting, form processing, email delivery, analytics, and payment processing — and who are permitted to use the information only to provide those services; with subcontractors or suppliers where necessary to complete work on your project; when required by law, subpoena, or other legal process, or to protect the rights, safety, or property of Apex Asphalt, our customers, or others; and in connection with a merger, acquisition, or sale of assets, in which case we will require the recipient to honor this Policy.

8. Data Retention

We keep inquiry and customer information for as long as needed to fulfill the purposes described in this Policy — including providing services, maintaining project and warranty records, and meeting tax, accounting, and legal obligations — and then delete it or de-identify it.

9. Security

We take reasonable measures to protect the information we hold. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you as required by applicable law.

10. Your Choices and Rights

You may request access to the personal information we hold about you, ask us to correct inaccurate information, or ask us to delete information we no longer need for a legitimate business or legal purpose. You may opt out of marketing communications at any time. To make a request, contact us using the details below. We may need to verify your identity before acting on a request.

Depending on where you live, you may have additional rights under state privacy law. We will honor applicable rights and will not discriminate against you for exercising them.

11. Children’s Privacy

The Site is intended for a general business audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us and we will delete it.

12. Third-Party Links

The Site may link to websites we do not operate. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies.

13. Changes to This Policy

We may update this Privacy Policy from time to time. The revised version takes effect when posted to this page, and the “Last updated” date above will reflect the change. If we make material changes, we will take reasonable steps to notify you.
